Welcome to breakingfor.parts ("we," "us," "our," or "the Platform"). These Terms of Service ("Terms") govern your access to and use of the breakingfor.parts website, services, and applications (collectively, the "Services"). By creating an account or using our Services, you agree to be bound by these Terms.
1. Our Service: A Marketplace for Connection
breakingfor.parts is a marketplace platform that connects car enthusiasts, mechanics, and restorers ("Users") for the purpose of buying and selling used automotive parts and vehicles.
Our Role:
We provide the venue for these connections. We are not a party to any transaction between buyers and sellers. We do not buy, sell, inspect, or take possession of any items listed on the Platform.
No Guarantees:
We do not and cannot guarantee the quality, safety, legality, or condition of any item listed. We do not guarantee the truthfulness or accuracy of user-generated content, the ability of sellers to sell items, the ability of buyers to pay for items, or that a buyer and seller will actually complete a transaction. All transactions are conducted at the Users' own risk.
2. User Accounts and Responsibilities
- Eligibility: You must be at least 18 years old to create an account and use our Services.
- Account Information: You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate.
- Display Name: You are required to choose a unique "Display Name." You may not impersonate others, and this name is tied to your reputation on the Platform and may not be easily changed. We reserve the right to reclaim or modify Display Names that are inactive, offensive, or infringe on trademarks.
- Account Security: You are responsible for safeguarding your password and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.
- Legal Name (for Future Use): While not required for basic registration, you may be asked to provide your legal first and last name in your private account settings. This information will be required for future features such as identity verification and payment processing and will be handled in accordance with our Privacy Policy.
3. Content and Conduct
Your Content:
You are solely responsible for all content, including images, titles, descriptions, and messages ("User Content") that you post on the Platform. By posting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, copy, display, and distribute your content solely in connection with the operation, promotion, and improvement of the Services.
Prohibited Items:
You may not list any item that is illegal to sell in your jurisdiction or that infringes on the intellectual property rights of others. This includes, but is not limited to, stolen parts, counterfeit items, and items that are subject to recall without proper disclosure.
Prohibited Conduct:
You agree not to engage in any of the following:
- Scamming, fraud, or deceptive practices.
- Posting false, misleading, or inaccurate information.
- Harassing, threatening, or abusing other Users.
- Circumventing our platform to complete transactions and avoid potential future fees.
- Distributing spam or unsolicited commercial messages.
- Using any automated means (bots, scrapers) to access the Services without our express written permission.
4. The Classified Ad Lifecycle
- User Control: Users may create, edit, and deactivate their listings through their Seller Dashboard.
- Deactivation (Soft Deletion): When a User "deactivates" a listing, it is not permanently deleted. The listing will be removed from public search results, the homepage, and the User's public profile. However, the listing will remain accessible via its direct URL to preserve the historical record of the item and any associated messages. This is a security feature to prevent the deletion of evidence in cases of disputes or fraud. Listings are retained for at least 12 months after deactivation unless otherwise required by law.
- Admin Moderation: All new listings and any edits to existing listings are subject to review by our administrators ("Admins"). We reserve the right, in our sole discretion, to approve, reject, or remove any listing for any reason.
- Rejection: If an Admin rejects a listing, it will be moved to a "Draft" state in the User's Seller Dashboard. The User may be provided with a reason for the rejection and will have the opportunity to edit and resubmit the listing for review.
5. Disclaimers and Limitation of Liability
"As-Is" Service:
The Services are provided on an "AS IS" and "AS AVAILABLE" basis. We expressly disclaim all warranties of any kind, whether express or implied.
Limitation of Liability:
To the fullest extent permitted by law, breakingfor.parts shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use of the Services; (b) any transaction or communication between Users; (c) any conduct or content of any third party on the Services — even if we have been advised of the possibility of such damages.
6. Indemnification
You agree to defend, indemnify, and hold harmless breakingfor.parts, its operators, and its affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses arising from your use of the Services or your violation of these Terms.
7. Termination
We may suspend or terminate your account and your access to the Services at any time, for any reason, without notice or liability to you. This includes, but is not limited to, a breach of these Terms.
8. Governing Law
These Terms shall be governed by the laws of Italy, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located in Italy for any dispute arising out of or relating to these Terms or your use of the Services.
9. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of any significant changes. By continuing to use the Services after those changes become effective, you agree to be bound by the revised Terms.
